Processing of (personal) data by the entity in charge of the online application process

PRIVACY POLICY FOR APPLICANTS


This information is directed to all applicants (hereinafter "you") who apply to Anyline GmbH ("Anyline" or "we"):

 Personal data

Personal data is any information relating to an identified or identifiable natural person (so-called "data subject"). Personal data therefore includes, for example, name, address, e-mail address, telephone number, date of birth, age, gender, social security number. In addition, there are also special categories of personal data (so-called "sensitive data"). The GDPR considers this to be personal data which, for example, reveals ethnic origin, political opinions, or religious affiliation.


In the context of the potential commencement of an employment contract, it is necessary for ANYLINE to process data of its applicants.

 Data processing within the scope of the application process

We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (Datenschutzgesetz), insofar as such data processing is necessary for our decision to establish an employment contract with us.


Failure to provide the personal data would hinder us from entering into an employment contract with you. We recommend that you only provide personal data that is required for the commencement of the employment relationship.


Personal data that we collect or process in the context of the establishment of an employment contract are:

We do not require any sensitive data from you within the meaning of Art 9 (1) GDPR, such as information on religion, political views or membership of a trade union, and ask you not to provide us with this. If you provide us with such sensitive data, we must obtain separate consent for its processing.

 Legal bases for processing

If the processing of your personal data is necessary for the initiation and establishment of an employment contract, the processing is based on Art 6 para 1 lit b) GDPR.


If processing is required due to a legal obligation (such as labor law or other provisions), the processing is based on Art 6 para 1 lit c) GDPR.


If the processing is necessary for the defense of asserted legal claims (for example, in proceedings under the Austrian Federal Equal Treatment Act (Bundes-Gleichbehandlungsgesetz)), the the processing is based on our legitimate interest in defending these claims within the meaning of Art 6 para 1 lit f) GDPR.


For processing operations where we obtain consent for a specific processing purpose, Art 6 para 1 lit a) GDPR serves as the legal basis. You have the right to withdraw your consent at any time - the processing carried out prior to your withdrawal remains lawful.

 Transmission of data to third parties

Only those offices receive your data that need them to fulfil our contractual and legal obligations. In addition, we make use of processors to whom your data is made available, in particular for our IT services, personnel transfer and visa or movement administration. All processors are contractually obligated to treat your data confidentially and are only authorized to process your data within the scope of their service provision.

The transmission of the data relevant in the respective individual case takes place on the basis of the legal regulations and/or contractual agreement to the following places

In case of transfer to third parties according to section 5.2, your personal data will be processed on our behalf on the basis of order processing contracts according to Art 28 DSGVO. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR.


If a legal dispute arises during or after termination of the employment relationship, the data required for appropriate legal action will be transmitted to legal representatives and courts.

 Data sources

We process personal data that we receive from you by mail or e-mail in the course of your contact with us or as part of your application, or that you transmit to us via a web form. Furthermore, we receive applicant data from personnel service providers (personnel consultants or personnel leasing companies) in the course of personnel placement or through the transmission of application documents via job portals (e.g. karriere.at, LinkedIn).

 Data processing outside the EU/EEA and categories of recipients

Your data may also be processed within Anyline’s group companies by employees outside the EU or EEA (namely in the USA). These employees are either employed by Anyline or its subsidiary, Anyline Inc. 2125 Center Ave, Suite 507
Fort Lee, NJ 07024. The adequate level of protection results from the conclusion of standard data protection clauses as well as additional security measures with the respective processors according to Art 46 para 2 lit c and d GDPR.


 Data retention

We store your personal data as long as this is necessary for the decision on your application. Your personal data or application documents will be deleted a maximum of seven months after the end of the application process (e.g. notification of the decision to reject your application), unless a longer retention period is legally required and permissible, or you have expressly consented to a longer retention period.


If an employment contract, apprenticeship or trainee contract is established following the application process, your data will initially continue to be stored insofar as this is necessary and permissible and will then be transferred to the personnel file.

 Automated decision making

Since the decision to enter into an employment contract with you is not based exclusively on automated processing, no automated decision in individual cases within the meaning of Art 22 GDPR takes place.

 Your rights as a data subject

As a data subject, you have the right at any time to information about your personal data, its origin and recipient and the purpose of data processing at Anyline. Furthermore, you have the right to rectification and data transfer and, if applicable, to object to or restrict the processing of processed personal data or delete incorrect or inadmissibly processed personal data.

If you are of the opinion that the processing of your personal data by ANYLINE violates applicable data protection law or that your data protection rights have been violated in any other way, you have the possibility to complain to the Austrian data protection authority.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. The use of cookies is absolutely necessary for providing our services and thus for the performance of the contract (article 6 (1) b) of the GDPR). Rights of data subjects

If Personio SE & Co. KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
